Protecting your privacy and the confidentiality of your personal information has always been an important aspect of LDD's operations. As a provider of desktop software and Web-based technology products, the collection and use of customers' personal information is fundamental to our day-to-day business operations.
We strive to provide you with the best customer service. To us, that includes treating your personal information fairly and with respect. Each LDD employee and representative must abide by our commitment to privacy in the handling of personal information. LDD is also concerned about the personal information of its employees and representatives.
Applicability of LDD's Privacy Code
LDD's Privacy Code informs you of our commitment to, and policy on, privacy. It tells you the ways we ensure that your privacy and the confidentiality of your personal information are protected.
In this Code, "we", "us" and "our" means LawyerDoneDeal Corp. (LDD). "You" and "your" means the individual who is a customer or potential customer of LDD. In other words, our Privacy Code applies to protect the personal information, in our possession and control, of all users of CorporateTracker Inc. software and the LDD website.
Our website may contain links to other websites that are provided and maintained exclusively by third parties. Websites provided and maintained by third parties are not subject to this Privacy Code. Please review the privacy policies on those websites to determine their information handling practices.
What is Personal Information?
Personal information, as defined by the applicable law, is any piece of information, either factual or subjective, about an identifiable individual. Personal information does not include the name, title, business address, e-mail address, or fax and telephone numbers of an employee of an organization.
The 10 Principles of Privacy
Our Privacy Code consists of the following ten key principles:
1. Accountability
At LDD, we take our commitment to securing your privacy very seriously. Each employee and representative of LDD is responsible for the personal information under his or her control. Our employees are informed about the importance of privacy and receive information periodically to update them about our Privacy Code and related policies.
In addition to establishing this Privacy Code, we have appointed a member of our senior management team - Stephen A. Austin, Vice-President - as LDD's Chief Privacy Officer. Mr. Austin is responsible for analyzing all personal information handling practices at LDD, and ensuring that our privacy policy is up-to-date and in force at all times.
2. Identifying Purposes: Why We Collect Information
Whenever we collect information about you, we will explain how we intend to use it, either at that time or earlier. We will limit the information we collect to what we need for those purposes, and we will use it only for those purposes. We will obtain your consent if we wish to use your information for any other purpose.
We ask you for information to establish a relationship and serve you. We obtain most of our information about you directly from you.
The information we ask for depends on which services you require from LDD. For example, personal information is required to:

evaluate your software/technology needs; and

determine which software/technology products or related services will meet those needs.
3. Consent
We seek and confirm your consent to use your personal information at the time of collection or in advance. We will endeavor to employ clear, understandable language when we obtain your consent.
Consent may be expressed in writing or implied, and in some cases, you may provide it verbally or electronically. Written consent includes completing and signing an application for an LDD product or service. Implied consent may be found where you choose to use an LDD product or service, such as one of our website.
All electronic communication ("e-mail") with you that is not essential to our products or services includes a straightforward "opt-out" feature that allows you to request that we cease e-mail communication with you. Not responding to our offer to have your name removed from the e-mail list is another form of implied consent.
The choice to provide us with personal information is always yours. Upon request, we will explain your options of refusing or withdrawing consent to the collection, use and release of your information, and we will record and respect your written choices. However, your decision to withhold particular details may limit the products or services we are able to offer.
4. Limiting Collection
Information is not collected by LDD without a specific, limited requirement. We collect information by fair and lawful means.
When you visit our website, information is not collected that could identify you personally unless you choose to provide it. You are welcome to browse the site at any time anonymously and privately, without revealing any personal information about yourself.
5. Limiting Use, Disclosure and Retention
The information we request from you is used for the purposes defined. We will seek your consent before using the information for purposes beyond the scope of your original consent.
Under no circumstances do we sell customer lists or other personal information to third parties for advertising or general marketing purposes. LDD's policy is to use personal information only to forward communications necessary or appropriate to the fulfillment of our obligations as a software/technology provider.
There are some unavoidable types of disclosure of your personal information which may occur occasionally as part of LDD fulfilling its routine obligations and/or conducting its business in the ordinary course. This includes, for example, partners, consultants and suppliers to LDD (also known collectively as "service providers"), assuming that they are abiding by LDD's Privacy Code and only to the extent necessary to allow them to provide business services or support to LDD, including technology, banking, financial, auditing, accounting, legal and insurance services.
We will retain your information only for the time it is required for the purposes we describe. Once your personal information is no longer required, it will be destroyed or made anonymous.
6. Accuracy
All decisions involving personal information should be based on accurate and timely information. While we will do our best to base our decisions on accurate information, we rely on individuals to disclose all material information and to inform us of any relevant changes.
We will make reasonable efforts to keep your information accurate and up-to-date, based upon satisfactory evidence provided by you and to the extent updated information is relevant to the purpose for which it was originally collected. We regularly cross-check our name and address information for lawyers with the Law Society of Upper Canada. We encourage our customers to review and confirm the accuracy of this information. If you find any errors in this information, we urge you to contact us as soon as possible (by phone, fax, mail, e-mail, or Internet), and we will make the appropriate corrections immediately, upon receipt of appropriate evidence.
7. Safeguards: Protecting Your Information
We will protect your information with appropriate safeguards and security measures, such as LDD’s computer usage and security policies. We audit our procedures and security measures regularly to ensure that they are being properly administered and that they remain effective and appropriate.
LDD maintains personal information in a combination of paper and electronic files. Paper records concerning individuals’ personal information are stored in files kept onsite at our Toronto office.
Access to personal information will be authorized only for LDD’s employees, representatives and service providers who require access in the performance of their duties, to any person granted access by the individual through the consent process and to those otherwise authorized by law.
When providing information to service providers acting on our behalf, we will require such organizations or individuals to abide by our Privacy Code. We will give them only the information necessary to perform the services for which they are engaged, and will prohibit them from storing, analyzing or using that information for purposes other than to carry out those services.
LDD’s computer systems, including portions of our website, are password-secured and constructed in such a way that only authorized individuals can access secure systems and databases. To safeguard against unauthorized access to your personal information via the Internet, you are required to "sign on" to certain secure areas of the LDD website using an individual, confidential password. Passwords to the LDD website are provided only upon verbal confirmation directly with the LSUC member or by use of an electronic system which contains identity verification processes. Generic passwords are only employed where there is no confidential information being displayed on the screen by LDD.
If you send us an e-mail message that includes personal information (such as your name included in the "address"), we will use that information to respond to your inquiry. Please remember that e-mail is not necessarily secure against interception. If your communication is very sensitive, or includes information such as your bank account or credit card number, you should not send it electronically unless the e-mail is encrypted or your browser indicates that the access to our website is secure.

9. Providing Individual Access

In some cases we may not provide access to personal information within our possession or control. This may occur when:

disclosure would reveal confidential commercial information of LDD;

LDD’s Security Policy outlines the measures and procedures undertaken by LDD to ensure that the personal information of our customers and employees is kept private and secure, in accordance with the terms of our Privacy Code. In this Policy, "we", "us" and "our" means LawyerDoneDeal Corp. ("LDD"), which includes CAKESoft Inc.. "You" and "your" means the individual who is a customer or potential customer of LDD.

Internal Security Controls
Only certain LDD staff who, because of the nature of their work must have access to information about you, can retrieve information from your master record. In other words, specific system, database, or application access is granted on an "as needed" basis and controlled on the basis of job function.
Unique user IDs and passwords are required for access to all LDD computer systems; staff users are responsible, and held accountable, for the assigned ID. Passwords are not to be shared among users and are changed on a regular basis. User accounts are disabled and passwords are changed upon termination of employment or contract.
LDD’s computer systems also have built-in audit functions that track access. These audit logs can be used to identify and track unauthorized attempts to access information.
Storage of personal information is not permitted on a routine basis on our desktop or laptop computer hard drives, except upon a customer’s express instructions, as part of providing work and services, which personal information is deleted from our staff user’s computer hard drive once work is completed. All computer files containing personal information are centralized on our secure servers, which are backed up on a regular basis. Special software applications are used to control access and maintain the security of the data in the systems.
Staff are aware that personal information (including paper files or documents, computer disks, CDs, and tapes) must not be left out in plain view where any unauthorized viewing by outsiders could occur. Our staff must log out of all applications at the end of each day and are required to close down applications containing personal information when absent from their desks for extended periods of time.
Paper files are stored in locked cabinets to which only certain LDD staff, due to the nature of their work, have access. Any important documents that are no longer needed and are to be discarded, are shredded in our offices.
External Access Controls
To protect the security and privacy of your personal information from unauthorized external access, access to LDD's premises is controlled by electronic access. Remote access to LDD computer systems by staff is limited by user IDs and passwords and is permitted on an "as needed" basis.
Entry to LDD websites is protected by firewall and routing software, and by access controls installed on the website servers. Critical servers are monitored by intrusion detection software, which reports unauthorized access or changes to the system.
Network and Server Security
LDD's co-located network and server environment is protected by VPN controls, where sensitive data is encrypted in transit. Unique accounts and passwords are required for authentication. In addition logging and auditing is enabled as a form of monitoring and integrity protection. Every security control employed by LDD to protect system information has been thoroughly tested and selected based on its features and performance.
The stability of the systems is assured by a UPS (uninterruptible power supply) and where appropriate, hardware redundancy features built into the servers. Industry-standard anti-virus software, updated regularly, is installed on the network and all desktop computers.
Data transmitted within LDD on its private network (or intranet) is not encrypted, nor are routine e-mail communications leaving the LDD network2. However, staff are encouraged to consider the sensitivity of material before transmitting it outside the network by e-mail.
Regular backups are performed on all systems, with backup tapes being stored securely for disaster recovery purposes. Only LDD staff have access to the backup data.
Web Security
1. Our Visitors: What we know
When you visit the informational (or non-secure) areas of our websites, only the following information is tracked:
•
the date and time you access our sites;
•
the pages and files that were accessed on the site; and
•
the operating system, browser type, browser version, and IP address of the computer from which you access our sites; and
•
the size of data our sites receive from you and the size of data our sites send to you.
Except as noted below, this information is only stored/reviewed in aggregate form, and only in order to monitor traffic patterns and volumes of use. We do not look at an individual’s use of our websites.
However, LDD does use industry-standard methods to identify unauthorized attempts to access, change or disrupt our websites or data. Such unauthorized access is strictly prohibited, and may be reported to the appropriate authorities and Internet service providers.
2. SSL and Encryption
In order to help protect your security when you communicate with LDD through our family of websites, we recommend that you use latest Internet browsers such as Microsoft® Internet Explorer 6.0 or higher, Mozilla Firefox® 1.5 or higher, Netscape Navigator™/Communicator™ 4.0 or higher which support 128-bit encryption, one of the strongest, most secure forms of encryption that is generally available in Internet browsers on the market in North America today.
The following section shows how to check your browser's encryption level.

To see your browser encryption rate, also known as cipher strength:

To see your browser encryption rate, also known as cipher strength:

Open your Netscape Navigator or Communicator browser.

Click Help on Netscape Navigator or Communicator toolbar.

•
In the window that opens, look for a section on RSA security.

If this section reads, "This version supports U.S. security," your browser supports 128-bit encryption. If the section indicates that you have an export version, your browser only supports 40-bit. (Further details are also available by clicking on Security on the Navigator toolbar)
To make sure that you have established an SSL (Secure Socket Layer) connection, confirm that the website address is displayed with "https://", rather than the standard "http://".
For your protection, we require that you "log in" to secure areas of our websites using the appropriate user name and password applicable to a particular LDD website or application. We suggest that you use a combination of letters and words for your password. Do not use words that can be associated with you easily, and change your password regularly.
Your password should be kept secret at all times because it is used to help verify your identity before you are permitted access to certain confidential information. If you are unable to provide the correct password, you will not be granted access.
We recommend that shared computers have browsers set to NOT save passwords for future use. This option is available in both Internet Explorer and Netscape.
When you log in successfully, your Web browser will establish a secure SSL connection between your computer and our website. When you leave the secure portion of our website, you will get a notification from your Internet browser that you are leaving the secure section, and returning to an open section.
4. Timed Logout
For certain applications on our websites and to further protect against unauthorized access to your accounts, our systems are designed to automatically log out if a secure online session is inactive for more than forty five minutes. If your session terminates, you will be prompted for your lawyer/firm number and password again before you can resume your online activities. Since most transactions on LDD’s family of websites take only minutes, this should rarely pose a problem. Alternatively and where appropriate, other applications on our websites have been designed not to automatically log out to ensure consistency and to reflect user workflow patterns.
5. Cache Storage
The "cache" storage in an Internet browser consists of copies of pages you have visited and information that you have entered during the course of your browsing session. Your browser also relies on its cached Web pages when you use the "Back" button on your browser.
For your transactions with LDD’s websites to work properly, caching must be activated on your Web browser before using the site. However, to protect the confidentiality of your personal information, you may choose to clear your browser's cache or temporary Internet files after completing your browsing session. The instructions for clearing cache are as follows:
For Microsoft Internet Explorer 6.x, select Tools, then Internet Options on the menu bar. Click the General tab, then click the Delete Files button. Do not click the "Delete Cookies" button, unless you wish to clear all cookies from your computer.
For Microsoft Internet Explorer 7.x, select Tools, then Internet Options on the menu bar. Click the General tab, then in Browsing History section click the Delete button, and then click the Delete Files button in the Delete Browsing History window. Do not click the "Delete Cookies" button, unless you wish to clear all cookies from your computer.
For Mozilla Firefox 1.5 or higher, select Tools, then Options on the menu bar. Click the Privacy tab, then click the Clear Now button in the Private Data section, and then check the Cache option and click Clear Private Data Now button. Do not check the "Cookies" option, unless you wish to clear all cookies from your computer.
For Netscape Navigator/Communicator 4 or higher, select Edit, then Preferences on the menu bar. Click Advanced, then Cache. Click the Clear Memory Cache button and the Clear Disk Cache button.
6. Cookies
In order for our websites to confirm and re-confirm your identity throughout the course of your transactions, a limited number of our applications make use of "cookies," which are small text files sent by a website to your Internet browser and stored on your computer. There are two types of cookies: "session" cookies and "persistent" cookies. The primary difference between session cookies and persistent cookies is that session cookies expire when you have finished your browsing session (e.g., closed your browser, or left it idle for an extended period of time), while persistent cookies may remain on your computer even after you have completed your browsing.

Your Data Is Safe with Us
At LDD, making sure that your data is properly stored is a high priority. That’s why we retain experts to carry out this important function. Storagepipe Solutions Inc. provides independent data backup services for all LDD web-based technology systems. Their backup servers are located on the same floor as LDD’s servers, at our co-location site. We do this to enhance security. Backup tapes are taken off-site daily, by bonded personnel, to Storagepipe’s secure storage vault. In the event that LDD permanently ceases to carry on business, LDD clients can retrieve their backed-up data from Storagepipe1 for a $100.00 Data Request Fee, per request.2
